2005年10月29日我們 (除孫忠凱外下面簽名者) 與魯飛飛和石梓一同參與創(chuàng)作一個(gè)藝術(shù)作品，復(fù)制著名的作品《為無(wú)名山增高一米》(1995年北京東村藝術(shù)家創(chuàng)作)，高氏兄弟擔(dān)任攝影。我們參與創(chuàng)作的唯一目的是為了參加《你、我和我們之間》慈善展覽，該展覽是為一個(gè)幫助孤獨(dú)癥兒童的慈善機(jī)構(gòu)“星星雨教育研究所”籌款。

　　我們參與此作品與魯飛飛個(gè)人的“復(fù)制”創(chuàng)作想法無(wú)關(guān)。我們參與創(chuàng)作此作品的唯一前提是：這件作品必須用于善良的動(dòng)機(jī)。我們?cè)噲D撰寫一份藝術(shù)合同，來(lái)取得一致意見(jiàn)。但是，在這件作品將來(lái)該怎樣使用的問(wèn)題上產(chǎn)生了分歧，在作品的拍攝過(guò)程中，我們沒(méi)有簽署任何合同。高氏兄弟一再地說(shuō)他們只是參與進(jìn)來(lái)幫助我們，所以他們并不是藝術(shù)家之一。

　　由于沒(méi)有達(dá)成一致意見(jiàn)，就決定不展出此件作品。直到現(xiàn)在我們還相信，唯一擁有照片底版和錄像資料的高氏兄弟和魯飛飛，他們會(huì)尊重我們的權(quán)利不會(huì)使用這些照片?？墒乾F(xiàn)在高氏兄弟卻在沒(méi)有得到我們的任何許可，也沒(méi)有任何預(yù)先通知的情況下，把這些照片用于他的新展覽中，冠名以《身體修辭》。他們的行為侵犯了我們作為藝術(shù)家的權(quán)利，也傷害了朋友之間的相互尊重。

　　因此，我們鄭重聲明，2005年10月29日在拍攝“復(fù)制《為無(wú)名山增高一米》”的過(guò)程中，高氏兄弟以及在現(xiàn)場(chǎng)的任何人在妙峰山拍攝的所有照片和錄像，極其副本，都不能當(dāng)成拍攝者自己的作品，都沒(méi)有著作權(quán)。我們中的任何人，包括高氏兄弟、魯飛飛、石梓，包括我們所有在下面簽名的人，在預(yù)先沒(méi)有獲得參與該作品的所有的藝術(shù)家和星星雨教育研究所的一致同意下，不允許使用以上所提到的照片和錄像， 包括諸如買賣和展覽等行為。如果誰(shuí)違反了這一原則就是侵犯了其他人作為藝術(shù)家的權(quán)利，侵犯了該作品的版權(quán)。

　　ANNOUNCEMENT:

　　Regarding the 2005 October 29 reenactment of To Add One Meter to an Anonymous Mountain

　　* On October 29, 2005, we the below signed excluding Sun Zhong Kai created an artistic

　　photographic reenactment of the well-known 1995 photograph “To Add One Meter To an Anonymous Mountain”， together with Lu Fei Fei and 石梓 and photographed by the Gao Brothers. This work was agreed as a joint creation under the sole purpose that it would be used for the charity exhibition “commonplace” (Beijing, November 2005) in order to help raise money for the Stars and Rain Institute for Autism.

　　Whether or not Lu Fei Fei first had the idea to create this copy is irrelevant, as we had agreed to participate in creating this work only under the premise that the work would be used for a good cause. We wanted to create an artistic contract to clarify the agreement, but because of disagreements as to how the work would be used in the future,we did not sign any contract at the time of shooting. The Gao Brothers

　　repeatedly said that they were only participating as help to us, that they were not taking any artistic license with the work.

　　Because of the lack of consensus, we decided not to exhibit the photographs. Until now, we have trusted the Gao Brothers and Lu FeiFei,who are in sole possession of the negatives of the photos and documentation video, to respect our rights not to use these photographs.

　　Now the Gao Brothers have, without any permission or prior notification,used these photos in their latest exhibition, entitled “Body Trope”。

　　Their doing so violates our rights as artists and harms our mutual respect as friends.

　　Therefore, with this announcement, we claim that any and all the photographs and video and their copies taken at MiaoFengShan on 29 October 2005 by the Gao Brothers or any of those present are not authorised. None of us, including the Gao Brothers, Lu Fei Fei, 石梓 or any of the below signed may use the photographs, video or any ensuing copies for sale or further exhibition without the prior written consent of ALL ARTISTS involved and STARS & RAIN INSTITUTE for AUTISM. Doing so is a violation of our rights as artists and a violation of copyright.
